People can legally set off fireworks in 91原创 as long as they adhere to a lengthy list of requirements that includes fireworks certification, and $5 million in liability insurance.
With the exception of some Canada Day fireworks displays, legal fireworks have become uncommon in 91原创 over the last few decades. However, illicit fireworks became extremely common around a few holidays 鈥 notably Halloween and New Year鈥檚 Eve. Despite the laws, this year could be noisy. Halloween and Diwali, an Indian celebration, fall on Thursday, Oct. 31.
Here's some of the rules to put on a legal display in the Township:
鈥 To sell, possess or transport fireworks in the Township, people must complete an Application for Fireworks Sales and attach the following:
- proof of a valid Fireworks Supervisor's Certificate issued by Natural Resources Canada
- a valid Township of 91原创 business licence
- a permit fee of $1,500 (for fireworks sales)
鈥 A permit will not be issued to an applicant who previously held a fireworks sales permit that was cancelled or rescinded during the past two years prior to the new application date.
鈥 Discharging fireworks: Complete an Application for Public Fireworks Event no less than 10 days prior to the event and attach the following:
- proof of a valid Fireworks Supervisor鈥檚 Certificate issued by Natural Resources Canada
- a site plan with measurements for spectator area and fireworks shooting area (fireworks cannot be discharged within 50 metres, or 150 feet, of anything flammable)
- identified event safety measures
- a letter of approval from the property owner for property use 鈥 See Schedule 5 of the Fire Prevention Bylaw
- Certificate of Insurance for no less than $5,000,000 general liability naming the Township of 91原创 as an additional insured with a deductible of $5,000 per event or greater if so deemed by the fire department.
- Agreement of Organizer or Sponsor of Public Fireworks Events form which has a permit fee of $115.
"The applicant must accept full responsibility to supervise as necessary and host this event in compliance with all applicable rules, regulations and product instructions to a safe and harmless conclusion to all participants, spectators and adjacent properties."
In April of 2022, Township council unanimously approved a plan to increase education on fireworks rules, create a dedicated email address for complaints about fireworks, and to add proactive patrols of RCMP and bylaws officers at fireworks hot spots around major holidays, including Halloween. The three recommendations came from a working group including firefighters, RCMP, and bylaw officials that was established in late 2021.
People can submit fireworks complaints within the Township to fireworkscomplaint@tol.ca, or call bylaw enforcement during regular office hours, 8:30 a.m. to 4:30 p.m. Monday to Friday. The RCMP non-emergency line can be called for concerns outside of those hours. For a bylaw infraction, the Township asks that people provide their name, phone number, the address where the incident is taking place, and a photograph of the incident.
鈥淲e don鈥檛 issue permits for fireworks unless they are industrial or commercial grade fireworks for official displays,鈥 deputy Township fire chief Russ Jenkins told the 91原创 Advance Times before Halloween last year.
The City bylaw is similar to the Township with fees to apply, strict rules on where and when a display can happen, and $5 million of insurance coverage required.
In 91原创 City, no fireworks sales are legal without a $50 permit. As well people wanting to set off fireworks must also have a permit which must be requested at least 10 days before the display date, and no one under 18 is allowed to discharge fireworks. People can be fined up to $10,000 for infractions.
